Rehearing of Board decisions

At the recent meeting of the Animal Remedies and Pesticides Boards a draft procedure covering the process for rehearing decisions of the Decision Making Committee (DMC) was discussed. The draft procedure proposes the following:

  • Applicants will be advised of their rights at the time a registration is declined and will be given the reason why the application is declined.
  • Applicants have 14 days to advise if they require a formal rehearing of the decision by the Board and can in that period supply any relevant additional information to support their case.
  • The DMC will reconsider any new information and may request further clarification from the applicants or seek an expert opinion.
  • If, as a consequence of a reconsideration of the application by the DMC, the original decision of the DMC is upheld applicants will be advised accordingly. Applicants are then advised of the time and venue of the Board meeting for the rehearing and may be present if they wish.
  • Where particular claims are declined but a registration is still granted, there are no grounds for a rehearing. The recourse of the applicant is to vary the registration.

The procedure will be revised in light of the comments of the Board members and posted on the website as soon as it is finalised.
