1 Food Safety Inspection Service Ruling on POS Documents
1.1 The insertion of point of sale information in cartons prior to export from New Zealand to the USA was raised recently by an exporter. On this occasion, this was initiated by a request from the US importer to insert a letter “To the Chef” extolling the virtues of the particular product. A number of “claims” were made in the letter that if included on a label would require a verifiable programme and submission to FSIS for label approval.
1.2 FSIS labelling personnel have advised that any form of POS information that makes any sort of “claim” must be subject to a verifiable programme. The same criteria that apply when making label claims apply equally to such documents.
1.3 Where POS documents making any form of claim and are intended for insertion into export cartons a verifiable programme as required by the US OMAR is needed. Once the verifiable programme has been approved by NZFSA VA, the associated label and POS documentation must be submitted to FSIS for approval.
