Official Assurances Programme
20 Certification of Consignments not specifically covered by OMARs
Version 7
December 2008
20.1 Application
This Part applies to all consignments for which export certificates are required or requested, which are not covered in the overseas market access requirements of the intended market.
NZFSA receives advice of new or unusual requirements from a number of sources, in particular from exporters engaged in contract negotiations.
Early receipt of this information gives NZFSA (Market Access) a greater chance to confirm the requirements and ascertain whether they can be met, prior to companies finalising the contract. Negotiations with foreign governments may take several months.
20.2 Preparation of New Zealand Standard Export Certificates
20.2.1 New Zealand standard export certificates are export certificates that are available to exporters for consignments of animal material or products consigned to an importing country where there are no overseas market access requirements notified or known.
20.2.2 New Zealand standard export certificates must be raised by the exporter in accordance with clause 20.4 of this Programme and the help-file on E-cert.
20.2.3 New Zealand standard export certificates may be issued by the authorised person at their discretion.
20.3 Commercial risk
20.3.1 All consignments certified under clause 20.2 are at the exporter’s own commercial risk. Commercial risk means acceptance by the exporter that the NZFSA certificates are given in good faith based on the exporter’s assurances that all necessary enquiries have been made and that there is no known impediment to entry of the product into the country concerned. It includes acceptance by the exporter that NZFSA will not intervene nor have any liability whatsoever for any loss, direct or indirect, that might occur to the exporter should the consignment be detained or rejected on arrival.
20.3.2 NZFSA will not provide export certificates at the exporter’s request, if the request is contrary to known general export or overseas market access requirements or to satisfy commercial arrangements of the exporter.
