Proposed Changes to the Regulation of Dietary Supplements

6 The Proposal

Food-type dietary supplements would be regulated as foods under a new set of regulations; and

Therapeutic-type dietary supplements would continue to be regulated under amended Dietary Supplement Regulations, administered by Medsafe, pending the move to regulation as therapeutic products (complementary medicines) under new therapeutic product legislation

Foods containing intoxicating substances in sufficient quantities to intoxicate would not be eligible for regulation as dietary supplements.

A new set of regulations, the Complementary Food Regulations (the Proposed Regulations) made under the Food Act (1981), would provide transitional regulatory coverage for food-type dietary supplements. The Proposed Regulations would be aligned, as much as possible, to the relevant provisions for composition and labelling in the Code with the intention of moving products into the Code at a future point in time as appropriate permissions become available.

It is important to align the Proposed Regulations for food-type dietary supplements with the relevant provisions for composition and labelling in the Code. This would assist products to move into the Code as appropriate permissions become available and would minimise the effect of differing standards in trans-Tasman trade.
