Proposed Changes to the Regulation of Dietary Supplements
8 Regulation of Therapeutic-type Dietary Supplements
It is proposed that therapeutic-type dietary supplements would remain under the Dietary Supplements Regulations as a transitional measure pending the passage of new legislation for therapeutic products. The Regulations would be amended to:
• exclude food-type dietary supplements (and foods for which there is an appropriate food standard available)
• include a sunset clause for the repeal of the Regulations when therapeutic product legislation covering complementary medicines comes into effect
• require the sponsors of products remaining under the Regulations in the interim to enter details of the products they distribute in New Zealand on to the complementary medicines transitional (COMET) database administered by Medsafe9.
The amended Regulations would be administered by the Ministry of Health.
Therapeutic claims in relation to products that remain under the amended Dietary Supplements Regulations will continue to be prohibited.
