Dairy Processors Operating Under Deemed Risk Management Programmes - Final Notice

As previously communicated, all dairy processors operating under a deemed risk management programme (RMP) are required to fully comply with the Animal Products (Dairy Risk Management Programme Specifications) Notice 2005 (Dairy RMP Specifications) by 31 May 2007. It was also noted in previous communications that the Animal Products Act 1999 (APA) requires operators to ensure evaluation and verification of the RMP by a Recognised Agency.

This notice applies to dairy processors who have not provided sufficient evidence to NZFSA confirming full compliance to the dairy RMP Specifications.

If you submitted a RMP for evaluation by a recognised agency or to NZFSA for registration prior to 31 May 2007 no further action is required in regard to this notice.

If you are not required to have a registered RMP under section 13 of the APA or if you have been exempted under section 14 you are required to notify NZFSA immediately regarding surrender of the deemed RMP and subsequent removal from the register.

If you are required to operate under a RMP and have not yet advised NZFSA how compliance will be demonstrated with the Dairy RMP Specifications, you will need to contact us urgently in writing (email, fax, letter) to advise this.

If NZFSA do not hear from you by 14 June 2007, it will be assumed that the requirements of the Dairy RMP Specifications are not being met. This means that any dairy material or dairy product held or processed will not be eligible for export certification. Action will also be taken by NZFSA Compliance and Investigation Group if you do not respond to NZFSA by this date.
