Registration of Amendments to Deemed Dairy Risk Management Programmes

STATEMENT OF POLICY
Animal Products Act 1999

1. Application

This statement of policy applies to applications for registration of amendments to deemed Dairy Risk Management Programmes, pursuant to section 25 of the Animal Products Act 1999.

2. Commencement

This statement of policy applies from the date of signing.

3. Interpretation

1. In this statement of policy, unless the context otherwise requires—

Act means the Animal Products Act 1999.

NZFSA means the New Zealand Food Safety Authority.

2. Any term or expression that is defined in the Animal Products Act 1999, Regulations or Specifications made under that Act and used, but not defined, in this statement of policy has the same meaning as in that Act, Regulations or Specifications.

4. Background

1. The Act does not contain any provisions that require operators of deemed Dairy Risk Management Programmes to submit their programmes for registration prior to the legislated deadline of 31 May 2007 to ensure compliance with the Animal Products (Dairy Risk Management Programme Specifications) Notice 2005.

2. NZFSA anticipates that potentially 230 applications will be made for the registration of amendments to deemed Dairy Risk Management Programmes to ensure compliance with the Animal Products (Dairy Risk Management Programme Specifications) Notice 2005. NZSFA experience of other industries indicates that most of the applications will not be submitted until shortly before the legislated deadline of 31 May 2007. In this event, it is unlikely that there will be adequate time for NZFSA to assess and register each application prior to 31 May 2007.

5. Policy on Applications for Registration of Amendments to Deemed Dairy RMPs

1. Applications received by NZFSA on or before 1 March 2007 to register an Amendment to a deemed Dairy RMP will be registered by 31 May 2007, provided that:

a. applications are received by NZFSA on or before 1 March 2007; and

b. the submitted programme meets the requirements of the Act and Specifications and all required documentation is complete and accurate.

2. Where an application for registration of an Amendment to a deemed Dairy RMP is received after 1 March 2007 NZFSA will endeavour to assess and register the programme by 31 May 2007.

3. Those businesses that are not fully compliant with the Dairy RMP Specifications by 31 May 2007 will be unable to operate under the Act.
