Consultation on proposals for a Dairy Quota Regulated Control Scheme

The New Zealand Food Safety Authority (NZFSA) is inviting public comment on a discussion document proposing a new Dairy Quota Regulated Control Scheme. The purpose of the Scheme will be to provide for New Zealand’s compliance with importing country dairy quota requirements.

Under the Dairy Industry Restructuring Act (DIRA), a wholly owned subsidiary of Fonterra Cooperative Group Ltd (Fonterra) held initial exclusive access to dairy quota markets. The initial exclusive allocation of rights to Fonterra expire progressively between June 2007 and December 2010.

On 24 May 2007 the Government announced policy proposals (prepared by the Ministry of Agriculture and Forestry) to amend the DIRA regarding the allocation of dairy market and quota and access rights. A Bill amending the DIRA has been drafted to put the policy frameworks in place and is expected to be introduced to the House within the next few weeks.

The Bill will provide for the rights to export to these dairy quota markets after the expiry of the initial allocations to Fonterra. These amendments will allow a wider group of dairy processors to participate in the exporting to these markets to provide future certainty to the industry.

NZFSA’s involvement in running the new system is to manage the certification and enforcement functions for rights allocated to the regulated dairy markets.
