New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002, Amendment No. 21
The Minister for Food Safety, under section 11L of the Food Act 1981, issues the following amendment to the New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002.
1. Title
These standards are the New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002, Amendment No. 21.
2. Commencement
This amendment comes into force 28 days after its notification in the New Zealand Gazette.
3. Amendment
The New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002 are amended by omitting clause 4 and substituting the following clause:
“4 The Food Standards Code
(1) Under section 11F of the Food Act 1981, these standards incorporate the Food Standards Code, as amended, up to and including Amendment No. 105 to the Food Standards Code.
(2) Despite clause 4(1), these standards do not incorporate those parts of the Food Standards Code identified in the Food Standards Code as applying only in Australia.”

Explanatory Note
This note is not part of the standards and has been included to explain their general effect.
The New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002, Amendment No. 21 adopts into New Zealand domestic law Amendments No. 102, 103, 104 and 105 of the Australia New Zealand Food Standards Code.
The New Zealand (Australia New Zealand Food Standards Code) Foods Standards 2002, Amendment No. 21 was notified in the New Zealand Gazette on 5 February 2009 and will come into effect 28 days after this date.
Amendment No. 102 to the Food Standards Code
Amendment No. 102 contains a minor change to an Australia-only cheese processing standard. Clause 4(2) of the New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002 states that Australia only standards are not incorporated into New Zealand law.
Amendment No. 103 to the Food Standards Code
Amendment No. 103 contains amendments to the Food Standards Code, including amendments to:
• allow the use of steviol glycosides as an intense sweetener (Standard 1.3.1); and
• allow the use of food derived from glufosinate ammonium-tolerant rice LLRICE62 (Standard 1.5.2); and
• correct typographical errors.
Amendment No. 104 to the Food Standards Code
Amendment No. 104 contains amendments to the Food Standards Code, including amendments to:
• allow the use of asparaginase from Aspergillus niger as a processing aid (enzyme) (Standard 1.3.3); and
• allow the use of food derived from insect-protected corn line MON89034 (Standard 1.5.2).
Amendment No. 105 to the Food Standards Code
Amendment No. 105 contains amendments to the Food Standards Code, including amendments to:
• allow the addition of galacto-oligosaccharides and inulin derived substances to infant formula products, foods for infants, and formulated supplementary foods for young children (Standards 2.9.1, 2.9.2 and 2.9.3); and
• increase the maximum level of cadmium in peanuts (Standard 1.4.1).
Food standards subject to Regulations (Disallowance) Act 1989
Food standards, including this amendment, are subject to the Regulations (Disallowance) Act 1989. Any person has the right to make a complaint about a food standard to the Regulations Review Committee.
