New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002, Amendment No. 1
The Minister for Food Safety, under section 11L of the Food Act 1981, issues the following amendment to the New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002.
1. Title
This standard may be cited as the New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002, Amendment No. 1.
2. Commencement
This amendment comes into force 28 days after its notification in the New Zealand Gazette.
3. Amendment
The New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002 are amended by omitting clause 4 and substituting the following clause:
"4 The Food Standards Code
(1) Under section 11F of the Food Act 1981, these standards incorporate the Food Standards Code, as amended, up to and including amendment No. 64 to the Food Standards Code.
(2) Despite clause 4(1), these standards do not incorporate those parts of the Food Standards Code identified in the Food Standards Code as applying only in Australia."

Explanatory Note
This note is not part of the standards and has been included to explain their general effect.
The New Zealand (Australia New Zealand Food Standards Code) Food Standards 2002, Amendment No. 1 adopts into New Zealand domestic law Amendment No. 64 of the Australia New Zealand Food Standards Code.
The New Zealand (Australia New Zealand Food Standards Code) Foods Standard 2002, Amendment No. 1 was notified in the New Zealand Gazette on 9th January 2003 and will come into effect 28 days after this date.
Amendment No. 64 of the Food Standards Code
Amendment No. 64 contains amendments to the Food Standards Code, including amendments that:
- allow, until 17 September 2004, milk products to carry warning statements that were contained either in the Australian Food Standards Code or the New Zealand Food Regulations 1984 (Standard 1.1A.5);
- permit, until 20 December 2003, the addition of caffeine to artificial drinks in New Zealand (Standard 1.1A.7);
- provide that stock-in-trade provisions do not apply to herbs, spices and dried vegetable seasonings treated with ethylene oxide (Standard 1.3.3) (Australia only);
- require a warning statement for royal jelly in food or when presented as a food, and an advisory statement for food containing bee pollen or propolis, and substitutes 'tree nuts' for 'nuts' (Standard 1.2.3);
- extend the declaration requirement for cereals to include the hybridised strains of those cereals (Standard 1.2.4);
- exempt certain home brew kits from the requirement to have a nutrition information panel (Standard 1.2.8);
- clarify food additive permissions for low joule chutneys and amend food additive permission for jelly (standard 1.3.1);
- extend to all bread the permission to add vitamins and minerals (Standard 1.3.2);
- allow processing aids able to be used as decolourants, clarifying and filtration agents to be also used as adsorbent agents (Standard 1.3.3);
- correct a typographical error for levels of quinine permitted in certain foods (Standard 1.4.1);
- amend maximum permissible limits for agricultural and veterinary chemical residues present in food (Standard 1.4.2) (Australia only);
- provide additional requirements for manufacture of extra hard grating cheese (Standard 1.6.2) (Australia only).
- amend processing requirements for cracked eggs to egg products derived from cracked eggs (Standard 2.2.2);
- update guidance on the specific naming of fish (Standard 2.2.3);
- update references to New Zealand processing requirements for milk and milk products (Standards 2.5.1 - 2.5.7);
- clarify, effective from 13 December 2003, the term 'juice' when used in infant products (Standard 2.9.2); and
- permit, effective from 13 December 2003, iron to be added to infant foods as electrolytic iron (Standard 2.9.2).
Food standards subject to Regulations (Disallowance) Act 1989
Food standards, including this amendment, are subject to the Regulations (Disallowance) Act 1989. Any person has the right to make a complaint about a food standard to the Regulations Review Committee.
