Application Information

The Wine (Recognised Agencies and Persons) Notice 2007 requires persons recognised as wine verifiers to be 'subject to the management of an agency recognised under section 69 of the Wine Act'.

Queries have been raised about what the phrase 'subject to the management of an agency...' means, specifically, whether a recognised person needs to be an employee of a recognised agency. The answer is no. The phrase 'subject to the management of an agency…' enables recognised agencies to use either employees for wine verification activities, or to engage a contractor to perform wine verification. The words 'subject to the management of an agency…' were deliberately used to enable agencies to contract specialist verifiers.

For example, if an individual who wishes to become recognised as a verifier does not also want to become a recognised agency, that individual has the option of contracting themselves to a recognised agency, i.e. becoming 'subject to the management of that agency.' It would then be up to the agency to ensure that the recognised verifier follows the procedures and policies of that agency for its wine verification activities.
