Overseas Market Access Requirements (OMARs) - Wine
The Wine Act 2003 provides a system of notifications and notices to assist grape wine exporters to comply with market access requirements imposed by foreign governments. This system is necessary to secure access to foreign markets for New Zealand's wine in an increasingly competitive international environment. It is administered by the NZFSA.
Section 41 of the Act requires that the Director-General* either notifies or makes available to exporters and makers of grape wine any particular overseas market access requirements (OMARs) for grape wine that New Zealand has recognised.
"Recognised" in this sense means that we have identified a need to notify overseas market access requirements in order to facilitate exports. This is usually because a foreign country requires that the New Zealand government takes steps to regulate a particular matter or provides an official assurance in respect of a particular matter. "Recognised" OMARs include those that are negotiated and agreed to between New Zealand and a foreign country, as well as those that are simply imposed by foreign countries where we recognise the need for exporters to comply with them if they wish to export.
* For the purposes of administering legislation, from 1 July 2007all references to the Director General denote the Chief Executive of NZFSA.
OMARs currently affecting New Zealand wine exporters are those relating to the European Union and the United States of America.

EU OMAR
On 31 July 2003, a notice was issued regarding grape wine exports to the EU, to ensure that NZ exporters could label their products in accordance with EU regulation 753/02.

USA OMAR
On 4 July 2007, an OMAR was issued regarding grape wine exports to the USA, to accommodate a variance between USA labelling requirements with regard to varietal composition and New Zealand standard requirements. This applies only to wine being exported to the USA.

Where OMARs have been notified or made available, the Director-General may also issue notices specifying the manner in which OMARs may or must be met. These notices will usually be issued where a foreign government requires that the New Zealand government take steps to regulate a matter in order for New Zealand wines to gain access to that market.
NZFSA is still in the process of assessing and compiling foreign government requirements and we will continue to notify or make available to industry further relevant OMARs as they become available to us. While we take all reasonable care in preparing such notifications, we cannot guarantee the accuracy or completeness of this information due to the difficulties involved in assessing and interpreting the requirements of overseas authorities. Nor can we guarantee that compliance with notified OMARs or notices will ensure access for a particular consignment into a particular market.
